1. Eligibility and Account Registration

InMotion30 is intended for adults aged 16 and older. By registering, you represent that:

• You are at least 16 years of age
• All information you provide during registration is accurate and complete
• You have the legal authority to enter into this agreement
• Your use of the Service complies with all applicable laws

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately at support@inmotion30.com.

2. Programs and Pricing

InMotion30 offers three 30-day fitness programs. Access is governed as follows:

• One free program — selected at account creation, no payment required
• Endurance and Mobility programs — available for a one-time purchase of $9.99 each, processed via Stripe

Purchases are one-time fees that grant permanent access to the purchased program. There are no recurring subscription charges under the current pricing model.

3. Refunds

Program purchases are generally non-refundable given the digital nature of the content. Exceptions:

• Billing errors or duplicate charges — contact us within 30 days for a review and refund if applicable
• Technical issues — if a purchased program is consistently inaccessible due to a fault on our end and we are unable to resolve it, we will issue a refund

4. Health and Fitness Disclaimer

The difficulty tiers and adaptive recommendations in InMotion30 are based on general fitness benchmarks and your self-reported performance data. They are informational tools, not medical prescriptions. Listen to your body and stop any exercise that causes pain or discomfort.

5. Acceptable Use

You agree to use InMotion30 only for personal, non-commercial fitness purposes. You may not:

• Share your login credentials with others or allow others to access your account
• Attempt to reverse engineer, scrape, or extract data from the Service or its underlying APIs
• Use automated tools or bots to access the Service outside of normal use
• Submit false or misleading information through the Service
• Resell, redistribute, or commercially exploit access to the Service or its content
• Use the Service in any way that violates applicable law

6. Intellectual Property

InMotion30, including its software, program design, workout content, and scoring methodology, is our intellectual property. Your account grants you a limited, personal, non-transferable license to access and use the Service for your own fitness purposes.

You may not copy, reproduce, or create derivative works from any portion of the Service's software, program content, or methodology.

7. Data and Privacy

Your use of InMotion30 is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by applicable law, InMotion30 shall not be liable for:

• Any injury, illness, or physical harm arising from participation in our fitness programs
• Any indirect, incidental, consequential, or punitive damages arising from your use of the Service
• Service interruptions, data loss, or technical failures beyond our reasonable control
• The accuracy or completeness of fitness scoring, tier recommendations, or progress data

Our total liability to you for any claim arising from your use of the Service shall not exceed the total amount you paid to us in the twelve months preceding the claim.

9. Service Availability and Modifications

We strive to maintain Service availability but do not guarantee uninterrupted access. Scheduled maintenance and events beyond our control may result in temporary unavailability.

We reserve the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of material changes that affect core functionality. Continued use of the Service following such changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved in the courts of Hays County, Texas, except that either party may seek injunctive relief in any court of competent jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will notify active users by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
